First steps if you’ve been injured in a public place in Queensland?

First and foremost, if you’ve suffered an injury, you should seek appropriate medical treatment. Once you are able to, and as early as possible, you should also attend to the following:

  • Notifying the owner or occupier of the premises where your injury occurred or the local authority where your injury was on, for example, council property;
  • Complete an incident report;
  • Keep notes of what happened and the interactions you have with the owner/occupier/local authority;
  • Take photos and/or video of your injuries and the location of the incident;
  • Keep records of all your medical treatment and expenses related to your injury;
  • Seek legal advice from a public liability lawyer as soon as possible.
  1. General damages (compensation) for pain and suffering;
  2. Past and future loss of earnings;
  3. Past and future loss of superannuation;
  4. Past and future medical treatment and related costs;
  5. Past and future care (in some circumstances).

Strict time limits apply to public liability claims in Queensland. Your entitlement to compensation may be lost if you claim late.

Generally, you will have three years from the date of the incident to pursue a public liability claim. There are additional statutory time limits for giving notice after an incident. In limited circumstances, there may be an opportunity to seek leave of the Court to pursue a claim outside the three year time limit.  Timely legal advice is crucial if you wish to consider lodging a claim.
